Delhi High Court Orders Blocking of Websites Illegally Streaming Undekhi Season 3 Series
The Delhi High Court recently mandated the blocking of numerous rogue websites illegally streaming and enabling downloads of the crime-thriller Undekhi Season 3 Series [Applause Entertainment Private Limited v. WWW.9XMovies.Com.Tw & Ors].
On May 20, Justice Sanjeev Narula directed internet service providers (ISPs), the Ministry of Electronics and Information Technology (MeitY), and the Department of Technology to block these websites.
“Defendants No. 1, 2, 14 to 19, and/or any person acting on their behalf, are restrained from communicating, hosting, streaming, screening, disseminating, reproducing, distributing or making available to the public for viewing/downloading, without authorization, any part of the Plaintiff’s ‘UNDEKHI’ web series/show in which the Plaintiff holds copyright, on any electronic or digital platform, in any manner whatsoever,” the Court stated.
This ruling was issued in response to a suit filed by Applause Entertainment Private Limited, the show’s producers. They informed the court that the third season of ‘Undekhi’ was released on May 10 on the Over-the-Top (OTT) platform Sony Liv. However, it was soon discovered that the series had been leaked and made available for free download on multiple websites.
Considering the seriousness of the issue, the court ordered the blocking of these websites. It also permitted the producers to submit applications to add any mirror, redirect, or alphanumeric websites found engaging in similar activities.
“Such applications shall be listed before the Joint Registrar, who, on being satisfied with the material placed on record, shall issue the appropriate directions to the internet service providers and the Defendants No. 12 and 13, DoT and MeitY respectively,” the Court ordered.
The legal team for Applause Entertainment included Advocates Harsh Kaushik, Anushree Rauta, Shwetank Tripathi, Deepank Singhal, Mohit Bangwal, and Y Prakash.
