Supreme Court to Examine Constitutional Validity of Laws Granting Marital Rape Immunity
NEW DELHI: The Supreme Court announced on Thursday that it will review the constitutional validity of certain provisions in the Indian Penal Code (IPC) and the Bharatiya Nyaya Sanhita (BNS) that provide immunity to husbands for committing marital rape against their wives, provided the wives are not minors.
A bench comprising Chief Justice of India D.Y. Chandrachud, along with Justices J.B. Pardiwala and Manoj Misra, has called for the petitioners to present their views on the Centre’s argument that criminalizing such acts could significantly disrupt conjugal relationships and undermine the institution of marriage.
Senior advocate Karuna Nundy, representing one of the petitioners, initiated the discussion by referencing the relevant provisions of the IPC and BNS concerning marital rape.
