Supreme Court Stays Execution of Death Sentence for Convicted Rapist and Murderer of Law Student

The Supreme Court has stayed the execution of the death sentence for Muhammed Ameer-Ul-Islam, convicted of raping and murdering a 30-year-old law student in Kerala in 2016

The bench, led by Justice B R Gavai and including Justices Sanjay Karol and K V Viswanathan, issued the order while hearing Ameer-Ul-Islam’s appeal against the Kerala High Court’s May 20 decision that upheld his conviction and confirmed the death sentence imposed by the trial court.

“The execution of the death sentence shall remain stayed pending the hearing and final disposal of the present appeal,” the bench stated in its order dated July 16.

The high court had upheld the death sentence for Ameer-Ul-Islam, a migrant laborer who was 22 years old at the time of the incident in April 2016. The court described the facts of the case as deeply disturbing, citing the “egregious violation of human dignity and sanctity of life” where the victim was horrendously murdered after being raped in an inhumane manner.

According to the prosecution, on April 28, 2016, the convict broke into the victim’s house with the intention of raping her. When she resisted, he attacked her with a knife, inflicting fatal injuries. The convict then fled to his home state of Assam and was arrested in June 2016.

The apex court has requested the original case record from both the trial court and the high court.

In its judgment, the high court expressed its heavy heart in upholding the death sentence, hoping the judgment would serve as a deterrent to prevent similar heinous acts in the future, thereby allowing people to live with a sense of security and without fear.

The trial court had convicted Ameer-Ul-Islam under various sections of the Indian Penal Code, including rape and murder, and sentenced him to death.
