Supreme Court Stays Further Proceedings, Seeks Clarification on High Court’s Re-Hearing Decision
The Supreme Court has directed the Registrar General of the Madras High Court to submit a detailed report, in a sealed cover, on the re-hearing of a Prevention of Money Laundering Act (PMLA) case that had initially been quashed. The case pertains to retired Indian Police Service (IPS) officer Jaffar Sait, against whom the Enforcement Directorate (ED) had filed a money laundering complaint.
A Supreme Court Bench comprising Justices Abhay S Oka and Augustine George Masih issued the directive after Senior Advocate Sidharth Luthra, representing the accused, informed the Court that the case, which had been quashed, was unexpectedly listed for hearing again. The Supreme Court has stayed all further proceedings in the matter before the High Court until further orders and scheduled the next hearing for September 30.
On August 21, the Madras High Court Bench of Justices SM Subramaniam and V Sivagnanam quashed the ED’s complaint against Sait. However, two days later, on August 23, the same Bench recalled its previous order and opted to re-hear the case on its merits.
