Registry Fails to Comply with Specific Court Order for Case Listing
The Supreme Court on Tuesday expressed dissatisfaction with its Registry for failing to list a case as per its specific directive [Sukhraj Labh Singh v. Zainab Rafiullah Sheikh and Others].
A Bench of Justices Abhay Oka and Augustine George Masih addressed the issue after being informed that the special leave petition (SLP) ordered to be listed on the day had not been included in the schedule.
“Despite a clear order dated August 12, 2024, the Registry failed to list SLP (C) Diary No. 25687/2024 today. When there is a direct order from the Court for listing a petition, the least we expect from the Registry is an explanation as to why this was not complied with,” the Court remarked.
The Bench has now asked the Registrar (Judicial Listing) to take note of the default and has scheduled the matter for hearing on September 6.
The case in question involves a land dispute over office/commercial premises in the Fort area of Mumbai. The Bombay High Court had previously dismissed appeals against the trial court’s ruling, prompting the appellant, whose late husband was involved in the earlier proceedings, to approach the Supreme Court.
Advocates Siddhant Buxy, Umesh Tawari, and Shambhavi Padhye represented the appellant in the matter.
