Supreme Court Mulls Interim Bail for Delhi CM Kejriwal Amid Lok Sabha Elections

On Friday, May 3, the Supreme Court indicated that it might need to consider granting interim bail to Delhi Chief Minister Arvind Kejriwal due to the ongoing Lok Sabha elections. Kejriwal’s plea challenging his arrest by the Enforcement Directorate (ED) is scheduled to be heard by the apex court on May 7.

Additional Solicitor General SV Raju, representing the ED, stated that the hearing on Kejriwal’s plea against his arrest is expected to be time-consuming, prompting the court to contemplate hearing the probe agency’s stance on interim bail.

The ED expressed concern that the Supreme Court’s observation might be exaggerated and clarified that Kejriwal has not formally applied for interim bail.

Raju affirmed his opposition to granting interim bail for Kejriwal, clarifying, “We are suggesting that we will deliberate on interim bail, not guarantee it. The decision to grant interim bail is subject to our discretion.”

Justices Sanjiv Khanna and Dipankar Datta, presiding over the bench, noted their intention to address the matter of Kejriwal’s involvement in signing official documents, given his continued tenure as Chief Minister.

Kejriwal is presently incarcerated in Tihar Jail in New Delhi under judicial custody following his arrest on March 21. The case revolves around alleged corruption and money laundering related to the formulation and implementation of the Delhi government’s now-defunct excise policy for 2021–22.

Earlier in the day, the Delhi High Court dismissed Kejriwal’s plea, deeming it inadmissible. The high court emphasized that Kejriwal possesses the necessary resources to approach the court and initiate appropriate legal proceedings.
