Supreme Court Fines PIL Petitioner ₹10,000 for Challenging Constitutional and Legal Provisions

Supreme Court Imposes ₹10,000 Fine on PIL Petitioner Challenging Section 149 BNS and Constitutional Provisions

The Supreme Court recently dismissed a public interest litigation (PIL) challenging the validity of Section 149 of the Bharatiya Nyaya Sanhita (BNS) and various provisions of the Indian Constitution. The Division Bench, comprising Justice Hrishikesh Roy and Justice SVN Bhatti, found no merit in the petition filed by Dr. SN Kundra and imposed a cost of ₹10,000 on the petitioner.

The PIL questioned several constitutional provisions, including:

– Article 52: President of India
– Article 53: Executive power of the Union
– Article 75(4): Oath administration to Ministers
– Article 77: Conduct of government business
– Article 102(2): Disqualification for defection
– Article 164(3): Oath to Ministers by the Governor
– Article 191(2): Disqualification for Legislative Assembly members
– Article 246: Law-making powers of Parliament and State Legislatures
– Article 361: Protection of the President and Governors
– Article 368: Amendment power and procedure

The petitioner also contested Section 149 of the BNS, which concerns penalties for acquiring arms with the intent to wage war against the government.

Following the dismissal of the plea, the Court directed the petitioner to deposit the imposed cost with the Supreme Court Legal Services Committee within a week.
