Supreme Court Directs NGT to Oversee Silicosis-Prone Industries and Ensure Compliance with Pollution Control Norms

The Supreme Court has instructed the National Green Tribunal (NGT) to monitor the effects of industries and factories across India that are prone to causing silicosis, a severe occupational lung disease caused by the inhalation of silica dust

The court also instructed the NGT to take any additional steps needed to prevent the spread of silicosis in such industries.

Compensation for Affected Workers

A crucial aspect of the Supreme Court’s directive is to ensure swift compensation for workers affected by silicosis or their next of kin. The court has tasked the National Human Rights Commission (NHRC) with overseeing the compensation process across different states. Additionally, the Employees’ State Insurance Corporation (ESIC) and state chief secretaries have been directed to cooperate with the NHRC to ensure the compensation is distributed efficiently and without delay.

Transfer of Reports and Affidavits

The Supreme Court has instructed its registry to forward all relevant reports and affidavits concerning this issue to the NGT and NHRC. This will enable these bodies to carry out their responsibilities effectively and without unnecessary delays.

Background of the Case

These directives from the apex court came while concluding a 2006 petition filed by the NGO People’s Rights and Social Research Centre. The NGO sought the Supreme Court’s intervention to address the serious issue of silicosis affecting workers in various industries across the country. According to the NGO, the widespread and unchecked prevalence of silicosis among workers represents a violation of their fundamental rights under the Constitution.
