Supreme Court Directs Madhya Pradesh High Court to Re-examine Termination of Six Women Judges

Supreme Court Asks Madhya Pradesh High Court to Review Termination of Six Women Judges

In June last year, the Madhya Pradesh government terminated the services of six women civil judges based on a recommendation from the Madhya Pradesh High Court. The Supreme Court of India has now asked the High Court to re-evaluate its decision to terminate these judges [In Re: Termination of Civil Judge, Class-II (JR. Division) Madhya Pradesh State Judicial Service].

A Bench comprising Justices BV Nagarathna and N Kotiswar Singh directed the full court of the High Court to reconsider the representations of the affected judges within one month.

“We request the full court of the Madhya Pradesh High Court to reconsider the cases of these judicial officers. On reconsideration, a copy of the resolution be placed before this court preferably within four weeks,” the Supreme Court ordered. The apex court had taken suo motu cognisance of the termination in January 2024.

Senior Advocate Gaurav Agrawal was appointed as Amicus Curiae to assist the Court in this matter, and notice was issued to the Madhya Pradesh High Court.

The terminations, carried out in June 2023, were based on a recommendation by the High Court following an assessment that found the judges’ performance during their probation period unsatisfactory. The termination orders were executed by the law department after an administrative committee and a full court meeting.

During an earlier hearing, the Supreme Court bench had orally asked whether the High Court was willing to reconsider its decision. When the case was heard again, the Amicus suggested that the High Court should re-evaluate its decision.

In light of this, the Supreme Court has passed an order requesting the High Court to re-examine the matter.
