Supreme Court Allows Students from Open Schools to Take NEET-UG Exam

The Supreme Court has approved the participation of students from open schools recognized by the Central Board of Secondary Education (CBSE) and State Education Boards in the National Eligibility-cum-Entrance Test (NEET).

During the hearing before a Division Bench comprising Justice PS Narasimha and Justice Aravind Kumar, the respondent’s counsel highlighted a letter dated November 2, 2023, from the Under Graduate Medical Education Board of the National Medical Commission (NMC).

According to the letter, open schools recognized by the CBSE and State Education Boards will be considered for recognition by the NMC for NEET eligibility.

Additionally, the counsel informed the Apex Court about a public notice issued by the board on the same date, stating that the National Medical Commission has formulated the Graduate Medical Education Regulations, 2023, which were officially notified on June 2, 2023.

As per Regulation 11(b) of the GME Regulations 2023, candidates who have completed 10+2 or its equivalent with Physics, Chemistry, Biology/Biotechnology, and English are eligible to appear for NEET-UG.

Consequently, the public notice stated that the earlier Regulations on Graduate Medical Education, 1997, along with various amendments, are repealed prospectively following the framing of the Graduate Medical Education Regulation, 2023.

In light of the referenced letter and public notice, the Bench disposed of the appeal, permitting eligible students from open schools recognized by CBSE and State Education Boards to participate in the NEET-UG examination.
