Naresh Goyal Granted Interim Medical Bail by Bombay High Court in Money Laundering Case

Bombay High Court Grants Interim Medical Bail to Jet Airways Founder Naresh Goyal in Money Laundering Case

The Bombay High Court has granted interim medical bail for two months to Naresh Goyal, the founder of Jet Airways, in a money laundering case pursued by the Enforcement Directorate (ED). Justice NJ Jamadar, presiding over a single-judge bench, ruled that Goyal would be released upon furnishing a bond of ₹1 lakh with sureties. Additionally, the court instructed Goyal to remain within the jurisdiction of the Prevention of Money Laundering Act (PMLA) court in Mumbai.

Goyal, who is currently receiving treatment for cancer at HN Reliance private hospital, had initially sought bail from the sessions court. Upon consultation with private doctors, it was revealed that he had malignant tumors, prompting his request for interim medical bail. Although the special judge allowed him two months of hospitalization for cancer treatment, his plea for permanent bail on medical grounds was rejected in April. This prompted Goyal to approach the High Court for relief.

Senior Advocates Harish Salve and Abad Ponda, along with the team from Naik Naik & Co represented Goyal. They argued for his bail on humanitarian grounds, emphasizing his need for a sterile environment during and after chemotherapy, which couldn’t be provided in jail. They also invoked his fundamental rights under Article 21, stating that he hadn’t been convicted, only accused.

Chief public prosecutor Hiten Venegaonkar, along with advocate Ayush, represented the ED and opposed the petition, highlighting Goyal’s continued hospitalization. They argued that there was no medical evidence suggesting he was fit for discharge. Venegaonkar stressed the priority of Goyal’s health and the necessity of ongoing hospitalization according to medical recommendations.
