Kesavananda Bharati Judgment a Landmark for Social and Economic Justice: Supreme Court Justice BR Gavai

Supreme Court Justice BR Gavai hailed the Kesavananda Bharati vs. State of Kerala judgment as a transformative milestone in advancing social and economic justice in India. Speaking at the SN Bhuyan Centenary Lecture in Guwahati, Justice Gavai emphasized the enduring impact of the landmark decision, which established the Basic Structure doctrine, underscoring its significance in the evolution of fundamental rights.

Justice Gavai, delivering the lecture on “75 Years of the Constitution of India: Dr. Ambedkar’s Vision and Social Justice,” reflected on the progress achieved since India’s independence. He noted that the judiciary, along with the executive and legislature, has made significant strides in addressing social and economic disparities, particularly highlighting advancements for women and marginalized communities.

Addressing the historical challenges faced by women pre-independence, Justice Gavai acknowledged the substantial improvements made in their status and opportunities over the decades. He lauded the achievements of individuals from SC/ST communities who have reached high positions, including women holding key roles such as Chief Secretary and Director General of Police in Maharashtra.

Justice Gavai attributed the nation’s progress in social and economic justice to the vision of Dr. B.R. Ambedkar and the Indian Constitution. He urged continued efforts to uphold and advance these principles as a tribute to both the Constitution and the late SN Bhuyan, who served as Assam’s Advocate General and was the father of Justice Ujjal Bhuyan.

The lecture also featured remarks from Justice Ujjal Bhuyan, who introduced Justice Gavai to the audience, and highlighted the importance of diverse viewpoints in a robust democracy. The event was attended by notable figures, including Supreme Court Justices Hrishikesh Roy and N. Kotiswar Singh, Gauhati High Court Chief Justice Vijay Bishnoi, Solicitor General Tushar Mehta, and other distinguished legal professionals.
