Delhi High Court Seeks ED’s Response on K Kavitha’s Bail Plea in Money Laundering Case

The Delhi High Court has requested a response from the Enforcement Directorate (ED) regarding the bail petition filed by Bharat Rashtra Samithi (BRS) leader K Kavitha in connection with a money laundering case linked to the now-defunct Delhi Excise Policy 2020-21.

Justice Swarana Kanta Sharma, presiding over a single-judge Bench, instructed the federal agency to submit its reply and scheduled further hearings for May 24.

Earlier, on May 6, a special court had dismissed Kavitha’s bail plea, leading to her appeal before the High Court.

Kavitha was arrested by the ED on March 15 from her residence in Banjara Hills, Hyderabad, following accusations of involvement in a money laundering case associated with the alleged Delhi excise scam. Additionally, the Central Bureau of Investigation (CBI) arrested her on April 11.

The case against Kavitha and others stems from the registration of a First Information Report (FIR) by the CBI in 2022, alleging manipulation of the Delhi Excise Policy of 2021-22 to facilitate the monopolization and cartelization of wholesale and retail liquor trade in Delhi.

Both the CBI and the ED claim that certain individuals/groups from South India benefited from this process, with some of their profits allegedly funneled to the Aam Aadmi Party (AAP) for campaigning during the Goa Assembly elections.

While the CBI registered the case under provisions of the Prevention of Corruption (PC) Act and the Indian Penal Code (IPC), the ED initiated proceedings under the Prevention of Money Laundering Act (PMLA).

Previously, the trial court had denied interim bail to Kavitha in the ED case.

The bail petition has been filed before the High Court through Advocates Deepak Nagar and Mohith Rao. Senior Advocate Vikram Chaudhari and Advocate Nitesh Rana presented arguments on behalf of the petitioner.
