The Jammu & Kashmir and Ladakh High Court (J&K High Court) has quashed a sexual harassment case against an IAF Wing Commander after a settlement was reached between him and the complainant, a fellow IAF officer. The court ruled that continuing the investigation would be futile following the mutual agreement.

The case involved allegations against a Wing Commander of the Indian Air Force (IAF) by a female pilot. The accusations included repeated demands for sexual favors, objectionable comments, and inappropriate touching.
Court’s Decision
The J&K High Court quashed the sexual harassment case following a compromise between the two parties. Justice Rajnesh Oswal ruled that continuing the investigation under Section 354A of the Indian Penal Code would be pointless given the settlement.

“In light of the settlement, the FIR registered at Police Station Satwari under Section 354-A IPC is quashed. Both parties are instructed not to publicize the matter or the resolved controversy in any form,” stated the Court. This decision came after the Wing Commander petitioned against the FIR filed in 2021.

During the petition’s pendency, the accused communicated with the complainant to settle the case. The female officer agreed and gave her no objection to quashing the FIR.
