High Court Provides Exception for Woman Delayed by Rain and Scooter Puncture
The Allahabad High Court recently provided relief to a woman who was unable to attend her exam due to circumstances beyond her control.
Justice Rajesh Singh Chauhan took note of the fact that heavy rain and a punctured scooter prevented her from reaching the exam center on time. Despite her best efforts to arrive punctually, these unforeseen events hindered her timely arrival.
In light of these circumstances, the Court decided to allow the candidate to take the exam as a special case, directing that she be permitted to appear for the Hindi Short Hand and Computer Typing Examination for the post of Additional Private Secretary, 2023, on the last date of the examination. This decision was rendered on July 15. The woman had been just two minutes late for her exam, which led her counsel to plea for reconsideration of her situation.
Her counsel explained that the combination of heavy rain and a punctured scooter was the cause of her delay. The request was made to the Court to direct the Uttar Pradesh Public Service Commission (UPPSC) to give her another chance to take the exam. While the counsel for UPPSC expressed concerns about setting a precedent that could potentially lead to a flood of similar requests, thus complicating the examination process, the Court acknowledged these concerns.
Despite understanding the potential implications, the Court decided to act on sympathy due to the unique facts of the case. The Court emphasized that this concession should not be considered a precedent for future cases. It instructed the UPPSC to allow the candidate to take the exam under these exceptional circumstances and advised that this concession be treated as a special case only.
Advocates Daya Shankar Tiwari, Aditya Pandey, and Amit Kumar represented the petitioner, while Advocate Raj Kumar Upadhyaya appeared for the UPPSC.
