Delhi High Court Quashes CCI Probe Against JCB, Emphasizes Respect for Mediation

Delhi High Court Stresses Importance of Upholding Mediation Outcomes in Legal Disputes

The Delhi High Court has set aside an inquiry initiated by the Competition Commission of India (CCI) against UK-based JCB and its Indian subsidiary for alleged abuse of dominant position, following a complaint by Bull Machine, an Indian tractor and attachments manufacturer. The court’s Division Bench, comprising Justices Prathiba M Singh and Amit Sharma, also quashed a trial court order that had issued search warrants against JCB [JCB India Limited and Anr v The Competition Commission of India and Anr].

The Bench ruled in favor of JCB, noting that Bull Machine had withdrawn its complaint after reaching a settlement with JCB through mediation. Despite this, the CCI had continued its investigation, which the court deemed unnecessary. The court underscored that regulatory bodies like the CCI must honor and respect mediation outcomes, emphasizing the importance of mediation in fostering amicable dispute resolution without regulatory interference.

“Mediation outcomes must be recognized and respected by all courts and forums, including regulatory authorities like the CCI. Such respect for settlements encourages parties to resolve disputes amicably without the fear of regulatory actions afterward,” the court stated.

The court warned that allowing investigations to continue after a settlement could undermine trust in the mediation process, dissuading parties from opting for such resolutions. It further highlighted that settlements should ensure “finality” and “closure,” as reopening resolved cases would compel parties to engage in costly legal battles.

Additionally, the Bench affirmed the rights of intellectual property (IP) holders to defend their IP and cautioned the CCI against intervening in matters that fall under the jurisdiction of High Courts or commercial courts.

The case stemmed from a 2014 CCI inquiry into JCB for alleged dominance abuse after JCB filed what was claimed to be a frivolous infringement lawsuit against Bull Machine. JCB had previously challenged the CCI’s jurisdiction over IP disputes in 2014 and a 2015 raid conducted on its premises related to the case. The two companies eventually settled their disputes through a Supreme Court-directed mediation in 2021.

JCB was represented by a legal team including Senior Advocates Sandeep Sethi and several other notable advocates, while Bull Machine and the CCI were represented by a separate team of advocates.
