Delhi High Court Confirms Dismissal of Rape Case Against BJP Leader Shahnawaz Hussain

Delhi High Court Upholds Decision to Dismiss Rape Case Against BJP Leader Shahnawaz Hussain

On August 2, the Delhi High Court upheld the decision to dismiss a rape case against BJP leader Syed Shahnawaz Hussain, affirming the earlier order by a sessions court. The case involved allegations from a woman who claimed that in 2018, Hussain had raped her at a farmhouse. However, after investigating the claims, the Delhi Police filed a cancellation report, which led to the case being closed.

Justice Neena Bansal Krishna ruled that the substantial oral, documentary, and scientific evidence collected during the investigation effectively disproved the allegations. The evidence established that both Hussain and the complainant could not have been at the farmhouse on the alleged date of the incident. Consequently, the court concluded that the evidence did not support the rape allegations, thereby validating the Additional Sessions Judge’s decision to accept the cancellation report.

The complainant had accused Hussain of taking her to his farmhouse, intoxicating her, and raping her, alleging that he had also recorded the incident and threatened her to keep it confidential. Initially, the FIR was filed only after interventions from the Delhi High Court and the Supreme Court.

In October 2023, a Magistrate Court had rejected the cancellation report filed by the Delhi Police and issued summons against Hussain. Hussain challenged this decision in the Sessions Court, which first stayed the summons and then quashed it. The complainant subsequently appealed to the High Court.

Representing the complainant were advocates Prabhoo Dayal Tiwari, Ajay Tiwari, Asif Iqbal, Unnati Agarwal, Ziaul Haq, Heena, Taran Jain, Asiph Shahid Ali, Shiwani Bhargava, Sakshi Bhayana, Akash Awana, and Aadesh Taneja. Additional Public Prosecutor Amit Ahlawat appeared on behalf of the Delhi Police. The High Court’s ruling concluded that there was no merit in the revision petition, affirming the dismissal of the case against Hussain.
