A Delhi Court in Delhi on Friday directed the Delhi Police to submit an action taken report regarding a complaint accusing Prime Minister Narendra Modi of using hateful language against Muslims in a recent election speech in Rajasthan.
In his speech, PM Modi claimed that if Congress were voted to power, it could distribute the nation’s wealth among “infiltrators” and “those who have more children,” referring to Muslims.
Metropolitan Magistrate (MM) Kartik Taparia requested the action taken report addressing the following points:
- Whether any complaint has been filed and what actions have been taken by the police in response?
- Whether any inquiry has been conducted based on the complaint?
- Whether any cognizable offence was identified during the inquiry?
- If a cognizable offence was found, whether an FIR has been registered by the police?
The Delhi Court set a deadline for the report to be filed by June 5.
The complaint, filed by Delhi resident Qurban Ali with the SHO of Police Station Hazrat Nizamuddin last month, alleges that Modi, during an election rally on April 21, made a speech that violated the Model Code of Conduct and included statements detrimental to national integration.
“In the speech, the Prime Minister, while campaigning for Bharatiya Janata Party, deliberately used language that insults the religious feelings of the Muslim community, promotes enmity between the Hindu and Muslim communities, and contains assertions prejudicial to national integration,” Ali stated in the complaint.
According to the complaint, Modi claimed that when the Congress party was in power, they said “Muslims have the first right to the national property.” The complaint further alleged that Modi referred to Muslims as infiltrators and those who have “more children.”
“Earlier, when they (the Congress) were in power, they had said Muslims have the first right to the wealth of the nation. This means they will distribute this wealth to those who have more children, to infiltrators. Should your hard-earned money be given to infiltrators? Do you agree to this?” Modi reportedly said during the speech, as per The Indian Express.
The complaint argues that Modi’s claims were false and that his speech perpetuated anti-Muslim propaganda and used communal language. It seeks the registration of a First Information Report (FIR) against Modi under various sections of the Indian Penal Code (IPC), including Sections 153A (promoting enmity between different groups), 153B (imputations prejudicial to national integration), 295A (outraging religious feelings), 298 (deliberate intent to wound religious feelings), 504 (intentional insult to provoke breach of the peace), and 505 (statements conducive to public mischief), as well as provisions of the Representation of the People Act, 1951, which prohibits soliciting votes in the name of religion.
After Hazrat Nizamuddin Police Station failed to register an FIR on the complaint, Ali filed an application in the Saket Court under Section 156(3) of the Code of Criminal Procedure. Advocate Ahmad Ibrahim represented the complainant.
