Delhi Court Grants Permanent Injunction to Adidas in Trademark Infringement Case
A Delhi court has granted relief to Adidas in a trademark infringement suit against a shop owner in Connaught Place who was found selling goods with fake Adidas logos [Adidas AG v Mr. Yogesh Gupta].
District Judge Vidya Prakash issued a permanent injunction restraining the shop owner from using Adidas trademarks and passing off products as those of Adidas. Additionally, the court awarded Adidas ₹1 lakh in damages and ordered the defendant to pay the costs of the suit.
“In the totality of the facts and circumstances of the case, the Court is of the view that the plaintiff (Adidas) has succeeded in proving that the defendant was stocking, distributing, and selling goods bearing falsified trademarks and logos of the plaintiff company and therefore, trademarks and copyright of plaintiff company are required to be protected,” the Court stated in its July 6 judgment.
The case began in 2019 when Adidas discovered that the defendant was running a wholesale business, selling goods with trademarks identical or deceptively similar to those of Adidas. The infringing products bore the name “adidas” and featured the “3-Stripes” mark, “performance logo,” and “Trefoil,” causing confusion among the public.
Adidas, represented by its authorised representative Narendra Singh, argued that these products were not genuine and were of inferior quality, deceiving the public, diluting Adidas’ goodwill, and causing significant losses. Adidas sought a permanent injunction against the defendant, the destruction of all goods bearing its trademark, an account of profits made from selling the infringing products, and punitive damages.
Despite being served summons, the shop owner did not appear before the court. Consequently, the court proceeded ex parte (without the defendant’s presence) and ruled in favor of Adidas based on a balance of probabilities.
