Delhi Court Orders FIR Against Former Employees of Fashion Designer for Criminal Breach of Trust

Court Takes a Stand: Protecting Brand Integrity in the Fashion Industry

A Delhi court has instructed the police to file a First Information Report (FIR) against two former employees of fashion designer Pallavi Mohan, citing allegations of criminal breach of trust. The employees are accused of running a parallel business while illicitly leveraging Mohan’s brand name and client base to market their own products.

The directive was issued by Judicial Magistrate Akshay Sharma after considering a complaint filed by ‘Not So Serious Trading LLP’, the company owned by Mohan. The court found merit in the arguments presented by advocates Sumit Gehlot and Nikhil Bhalla, who represented the fashion label, asserting that there is sufficient evidence to establish that a cognizable offence has occurred. The ruling underscores the legal implications of misusing a brand and highlights the importance of protecting intellectual property rights in the fashion industry.
