CJI DY Chandrachud Advocates for Fair Recruitment Practices to Boost Women’s Participation at the Bar

CJI Advocates for Transparent Recruitment to Enhance Women’s Representation in Law

Chief Justice of India (CJI) DY Chandrachud has called for a shift in recruitment practices for junior advocates, urging senior lawyers to adopt a more transparent and equitable approach. Instead of relying on personal connections and networks, CJI Chandrachud recommended that seniors should invite applications and conduct interviews to ensure a fair chance for all candidates. This change aims to level the playing field and enhance women’s representation in the legal profession.

Speaking at the farewell ceremony for Justice Hima Kohli, the ninth woman judge of the Supreme Court, CJI Chandrachud emphasized the need for merit-based recruitment. He noted that women excel in any field when given an equal opportunity, including the judiciary.

“The issue with the legal profession is the lack of a level playing field. I urge senior advocates to stop recruiting based solely on personal networks or connections. The Supreme Court Bar Association (SCBA) could facilitate a process where seniors express their recruitment needs, and candidates can apply and be interviewed accordingly. A fair process will demonstrate that women can succeed when given equal opportunities,” CJI Chandrachud said.

He also highlighted his recent observations from a Lok Adalat in Delhi, where he noted that 78 out of 108 new recruits to the Delhi district judiciary were women. This, he said, reflects the positive impact of equal opportunity environments on women’s success.

In his address, CJI Chandrachud praised Justice Kohli for her judicial sensitivity and advocacy on women’s issues within the profession. He underscored that women need not forsake their femininity to succeed in law, and should instead bring their unique qualities to the field.

Supreme Court Bar Association President Kapil Sibal echoed CJI Chandrachud’s sentiments, advocating for increased appointments of women judges to the High Courts and Supreme Court. He also urged for greater recognition of women lawyers in commercial law firms.
