600 Lawyers Write Letter to CJI DY Chandrachud: Some Lawyers Defend Politicians by Day and Seek to Influence Judges Through Media by Night

Over 600 lawyers write to CJI DY Chandrachud Dual Roles of Some Lawyers Impacting Judicial Trust and Harmony by Defending Politicians and Influencing Judges

A letter addressed to the Chief Justice of India (CJI) DY Chandrachud has been penned by approximately 600 legal professionals, expressing deep concerns about a troubling pattern observed among certain lawyers. These lawyers, as the letter suggests, appear to switch roles from defending politicians during the day to trying to influence judges through media channels at night.

The letter, which includes signatures from eminent Senior Advocates such as Harish Salve, Manan Kumar Mishra, Adish Aggarwala, Chetan Mittal, Pinky Anand, Hitesh Jain, Ujjwala Pawar, Uday Holla, and Swaroopama Chaturvedi, conveys serious apprehension over attempts to compromise the judiciary’s integrity.

“We, the undersigned, are a group of lawyers reaching out to express our deep concerns about the manner in which a particular interest group is attempting to exert pressure on CJI DY Chandrachud, influence the judicial process, and tarnish our courts using unfounded arguments and outdated political agendas,” the letter read.

The letter further highlighted how the actions of such lawyers are eroding the trust and harmony that are essential for the judiciary’s smooth functioning.

“They often spin tales about a supposedly ‘better era’ in the courts and compare it unfavorably with the present situation,” the letter claimed.

This pressure is most palpable in political cases, particularly those involving politicians accused of corruption. Such tactics are not only detrimental to the courts but also pose a significant threat to India’s democratic fabric. “This vocal interest group uses various tactics. They fabricate stories of an alleged ‘golden age’ of the courts, contrasting it with current events. These are deliberate claims aimed at influencing court decisions and undermining the court, especially CJI DY Chandrachud, for certain political advantages,” the letter asserted.

Moreover, the letter accused these lawyers of promoting the notion of ‘bench fixing,’ a theory that not only shows disrespect and contempt but also tarnishes the courts’ honor and dignity. At times, it results in slanderous remarks and insinuations against esteemed judges. “They have even gone to the extent of comparing our judicial system to those of countries where the rule of law is absent, casting aspersions on CJI DY Chandrachud‘s integrity. These are not mere criticisms; they are direct assaults aimed at eroding public trust in our judiciary and undermining the fair implementation of our legal system,” the letter said.

The letter further highlighted a clear bias in these lawyers’ approach. “They applaud any decision they align with, while discrediting, disparaging, and dismissing any decision they disagree with. This selective approach has been evident in recent judgments as well,” it added.

The letter concludes by emphasizing that such attempts to diminish and manipulate the courts for personal and political motives cannot be tolerated under any circumstances. “We urge the Supreme Court, led by CJI DY Chandrachud, to stand firm and take measures to shield our courts from these assaults. Maintaining a dignified silence or taking no action could inadvertently empower those intending harm. This is not the time for a quiet dignified stance, especially since such efforts have been escalating over the past few years,” the lawyers urged.

In conclusion, the letter serves as a significant wake-up call to the judiciary and the legal fraternity to uphold the sanctity and impartiality of the legal system. With the CJI DY Chandrachud at the helm, it is imperative to address these concerns promptly
