Chief Justice of India DY Chandrachud Urges Legal Community to Uphold Judicial Integrity

Chief Justice of India DY Chandrachud Emphasizes Importance of Independent Bar and Responsible Legal Discourse

Chief Justice of India DY Chandrachud has expressed his concern regarding the tendency of members of Bar Associations to comment on cases that are pending before the court and to critique judgments delivered by the court.

Addressing the three-day centenary celebration of the High Court Bar Association at Nagpur Bench of Bombay High Court, the CJI underscored the pivotal role lawyers play as officers of the court, and it is their responsibility to uphold dignity and truth in legal discourse.

Highlighting the close relationship between the independence of the judiciary and the independence of the bar, the CJI emphasized that verdicts of constitutional courts result from meticulous proceedings, thorough legal analysis, and a commitment to constitutional principles. He stressed that once a judgment is pronounced, it becomes public property.

The CJI urged lawyers to have broad shoulders, being prepared to receive both praise and criticism, whether through journalistic pieces, political commentary, or on social media.

Emphasizing the importance of an independent bar and its associations, he urged lawyers to distinguish themselves from laypersons while reacting to court judgments and engaging in legal discussions.

While acknowledging that lawyers, like any other individuals, may have political inclinations, the CJI emphasized that their highest loyalty should lie with the courts and the Constitution, rather than partisan interests.

He observed that an independent bar plays a significant role in safeguarding the rule of law and constitutional governance, acting as a moral stronghold.

The CJI stressed that the role of Bar Associations should extend beyond advancing the immediate concerns of lawyers to enhancing the functioning of the judiciary and protecting the dignity of the court.

He referred to recent incidents of violence against lawyers, emphasizing the responsibility of Bar Associations to ensure the safety of lawyers practicing before the court.

With the advent of hybrid hearings allowing lawyers from across the country to appear before courts in different regions, the CJI called for Bar Associations to adopt a more inclusive approach to ensure the safety and welcoming of all lawyers.
