Bombay High Court Clears Civic Bodies, Focuses on Road Conditions in Public Interest

No Contempt Action Against Civic Bodies Over Pothole Orders, Says Bombay High Court

MUMBAI: On Tuesday, the Bombay High Court decided not to initiate contempt proceedings against various civic bodies in Maharashtra for failing to comply with its 2018 orders regarding the poor state of roads and potholes. The court acknowledged the genuine efforts made by these bodies and their noticeable improvements.

A division bench, led by Chief Justice D.K. Upadhyaya and Justice Amit Borkar, announced it would revive a 2013 public interest litigation (PIL) that it had taken up suo motu, emphasizing that the matter concerns public welfare.

The bench underscored that citizens have a fundamental right to access well-maintained streets and footpaths, and it is the responsibility of civic authorities to ensure these spaces are in a usable condition.
