Supreme Court Allows Bail for Bhima Koregaon Case Accused Gautam Navlakha
The Supreme Court granted bail to Gautam Navlakha, one of the accused in the Bhima Koregaon case, under the condition of paying Rs 20 lakh for his house arrest. This decision came from a Bench comprising Justice MM Sundresh and Justice SVN Bhatti, following a petition filed by the National Investigative Agency (NIA) against the Bombay High Court’s previous bail order for Navlakha.
Navlakha, an activist, was arrested on April 14, 2020, in connection with the violence at Bhima Koregaon village on January 1, 2018. In November 2022, the Supreme Court placed him under house arrest due to health reasons.
The Bombay High Court granted bail to Navlakha in December 2023, citing insufficient evidence to conclude that he had committed a terrorist act under Section 15 of the Unlawful Activities (Prevention) Act. However, the High Court’s decision was temporarily stayed upon the NIA’s request to challenge it in the Supreme Court.
In today’s ruling, the Supreme Court lifted the interim stay, noting that Navlakha had been detained for over four years and that the trial was likely to extend for a considerable period. Additionally, the court considered that charges had not yet been framed against Navlakha.
