Supreme Court Defends Press Freedom: No Criminal Charges for Government Criticism

The Supreme Court asserted on Friday that journalists should not face criminal charges simply for expressing views that criticize the government. Justices Hrishikesh Roy and SVN Bhatti emphasized that in democratic societies, freedom of expression is paramount and that journalists’ rights are safeguarded under Article 19(1)(a) of the Constitution.

This statement came during a hearing regarding a plea by journalist Abhishek Upadhyay, who sought to quash an FIR filed against him in Uttar Pradesh. The FIR stemmed from his publication on the “caste dynamics of the general administration” in the state, which was perceived as critical of the government.
