Stay Granted as AAP Leaders Challenge BJP’s Claims Over Voter Deletion Allegations
The Supreme Court has stayed the criminal defamation case against Delhi Chief Minister Arvind Kejriwal and AAP leader Atishi, related to allegations about the deletion of voters’ names from electoral rolls in Delhi. The case was initiated by BJP leader Rajiv Babbar, who claimed that during a press conference in December 2018, the AAP leaders falsely stated that approximately 30 lakh voters, primarily from Bania, Poorvanchali, and Muslim communities, had their names removed from the voter list on the BJP’s instructions, thereby harming the party’s reputation.
Justices Hrishikesh Roy and SVN Bhatti sought responses from the Delhi Police and Babbar regarding the matter and have stayed the criminal proceedings against Kejriwal and Atishi. Previously, the Delhi High Court had denied the AAP leaders’ request to quash the case, stating that while citizens deserve truthful information, political mudslinging is unacceptable. The High Court characterized AAP’s allegations as defamatory and aimed at maligning the BJP for political gain.
Following the High Court’s decision, Kejriwal and Atishi appealed to the Supreme Court. Senior Advocate Dr. Abhishek Manu Singhvi, alongside a team of advocates, represented the AAP leaders, while Senior Advocate Sonia Mathur represented Babbar.
