A bench led by Chief Justice DY Chandrachud urged the Central government to consider forming an Expert Committee to create a thorough health and sex education framework.
The Court highlighted widespread misconceptions about sex education in India, noting that societal stigma prevents open discussions about sexual health, leading to significant knowledge gaps among adolescents. It criticized the common belief that sex education promotes promiscuity, citing research indicating that such education actually delays sexual activity and encourages safer practices.
Addressing the notion that sex education is a Western concept incompatible with Indian values, the Court argued that this view hinders effective implementation of sexual health programs, leaving many young people uninformed. It also referenced successful initiatives, like the Udaan program in Jharkhand, as examples of effective sex education in India.
The Court underlined that sex education should encompass not just biological reproduction but also topics such as consent, healthy relationships, gender equality, and respect for diversity. These elements are essential for reducing sexual violence and promoting gender equity.
Moreover, the Court stated that positive sex education could counteract the distorted perceptions associated with child pornography, fostering empathy and respect while teaching the importance of consent and the legal consequences of sexual activities.
It pointed out that Sections 43 and 44 of the POCSO Act require both Central and State governments to raise public awareness and ensure the implementation of its provisions, emphasizing that this responsibility includes imparting sex education in schools.
In conclusion, the Court asserted that the collective responsibility lies in ensuring support for victims of child pornography and fostering a compassionate society that addresses the needs of these individuals while holding perpetrators accountable.
