Bombay High Court Transfers Abhishek Ghosalkar Murder Case to CBI Due to Police Lapses

The Bombay High Court on Friday ordered the transfer of the investigation into the murder of former Shiv Sena (UBT) corporator Abhishek Ghosalkar to the Central Bureau of Investigation (CBI), citing deficiencies in the police probe

A division bench led by Justice Revati Mohite Dere granted the petition filed by Ghosalkar’s wife, Tejasvee Ghosalkar, who expressed concerns about the Mumbai Police’s investigation and requested that the case be transferred to the CBI. The court noted that certain aspects of the case had not been adequately investigated by the police.

The petition argued that the Mumbai Police’s investigation was “stalled” and that there was little progress in the case, prompting the call for a more thorough investigation by the CBI.

Abhishek Ghosalkar, 41, son of former Shiv Sena (UBT) MLA Vinod Ghosalkar, was shot dead in Borivali, Mumbai, on February 8 during a live social media broadcast. His long-time political rival, Mauris Noronha, 47, allegedly committed suicide shortly after the incident. The next day, police arrested Noronha’s bodyguard, Amarendra Mishra, suspecting that his gun had been used in the crime.

Initially, the MHB police station in Borivali registered a case against Noronha under Section 302 (murder) of the Indian Penal Code, along with provisions of the Arms Act and Maharashtra Police Act. The case was later handed over to the Crime Branch. On June 25, the Sessions Court granted bail to Amarendra Mishra.
