Kumar Appeals to Supreme Court After High Court Dismissal Over Alleged Election Irregularities
BJP leader D Krishna Kumar has escalated his legal battle to the Supreme Court, contesting the election of Congress MLA Dr. HD Ranganath from Kunigal, following a rejection of his petition by the Karnataka High Court. The high-profile case [D Krishna Kumar v. HD Ranganath and ors] concerns the 2023 Karnataka assembly elections where Kumar, who has now lost twice in the same constituency, argues that Ranganath’s victory was tainted by electoral misconduct.
On Monday, Justices Surya Kant and Ujjal Bhuyan of the Supreme Court issued a notice to Dr. Ranganath and scheduled a hearing for two weeks. Kumar’s initial petition was dismissed by the Karnataka High Court on June 21, with the court finding it lacked substantive factual details and failing to present a triable issue or cause of action. The High Court criticized Kumar’s claims as speculative and based on conjecture.
Kumar’s allegations include claims that Ranganath distributed dinner sets, kitchen utensils, and prepaid cards to influence voters and misrepresented his assets and liabilities in his affidavit.
Senior Advocate Nalina Mayegowda, along with a team of advocates including Priyadarshi Banerjee, Anusha B Reddy, Santosh B, Rishikesh M Kotturshettar, Rishabh Singhle, and Sujoy Chatterjee, is representing Kumar. Senior Advocate Devadatt Kamat and advocates Mayank Jain, Parmatma Singh, and Madhur Jain are representing Ranganath.
