Supreme Court Addresses Nationwide Delay in Tribunal Compensation Distribution
The Supreme Court has asked five High Courts to submit their responses in a suo motu case addressing delays in the distribution of compensation awarded by tribunals in motor accident and labour cases across India [In Re Compensation Amounts Deposited with MACTs and Labour Courts].
A Bench comprising Justices Abhay S Oka and Augustine George Masih directed the High Courts of Delhi, Bombay, Calcutta, Allahabad, and Madras to provide their replies regarding the matter. This case was initiated following an email sent by a retired district court judge from Gujarat to Chief Justice of India DY Chandrachud, highlighting the issue of undistributed compensation in the State.
The top court noted that compensation amounting to ₹2,000 crores meant for victims of motor accidents and beneficiaries of Labour Courts in Gujarat was still pending distribution. Initially, the Court sought responses from the Gujarat government and High Court, but soon realized that the problem was prevalent nationwide.
To address this issue, Senior Advocate Meenakshi Arora was appointed as Amicus Curiae. During the proceedings, Arora suggested that the Court could start by issuing directions to the larger High Courts, which led to the current order. Advocate Vishakha, representing the Gujarat High Court, is assisting the Amicus, while Advocate Deepanwita Priyanka appeared for the State of Gujarat.
The Supreme Court aims to resolve these lapses and expedite the process of distributing compensation to the rightful beneficiaries.
