MACT Awards Over ₹48 Lakh to Families of Cousins Killed in 2014 Accident

The Thane Motor Accident Claims Tribunal (MACT) has granted over Rs 48 lakh in compensation to the families of two cousins who tragically died in a road accident in December 2014

The victims, Shyam Gopal Farde (40) and Gurunath Govind Farde (26), residents of Farde Pada in Shahapur, were fatally injured when their scooter was hit by a vehicle in Shelavli village on December 5, 2014.

The order, dated August 9, was made public on Monday.

MACT Chairman SB Agrawal ordered the vehicle owner and New India Assurance Company to compensate the victims’ families. Shyam Farde’s family was awarded Rs 32,29,000, while Gurunath Farde’s family received Rs 16,00,000.

Both families are also entitled to interest at 7.50% per annum from the date of the claim filing. However, the Tribunal specified that no interest would apply to compensation awarded for future prospects.

The MACT chairman dismissed the insurance company’s arguments, deeming them “palpably frivolous.” The case proceeded ex-parte against the vehicle owner, who failed to appear before the tribunal, while the insurance company, represented by advocate AK Tiwari, contested the claim on several grounds.

Advocate MA Pendse, representing the petitioners, argued that the accident was caused by the negligent, high-speed driving of the four-wheeler’s driver.

The MACT chairman held the respondents accountable for the accident and ordered them to pay the compensation, noting that the insurance company’s attempts to avoid liability were baseless and lacked merit.
