Justice Kaul Calls for Expertise in Tribunals Handling Commercial Disputes

Retired Supreme Court Justice Sanjay Kishan Kaul recently expressed concerns over the Union Finance Ministry’s decision advising government agencies to avoid arbitration in cases involving amounts exceeding ₹10 crores. He argued that this move is counterproductive, especially in fostering a strong arbitration ecosystem in India. Speaking at the launch of *Commercial Dispute Resolution – State of the Law in India* by Anirudh Krishnan, Justice Kaul stressed the importance of arbitration and mediation in resolving commercial disputes and called for tribunal experts rather than retired judges to handle such cases efficiently. He also highlighted the slow pace of commercial dispute resolution in India, calling for reforms to streamline the process and reduce unnecessary trials.
