Delhi High Court Orders Samajwadi Party to Remove Defamatory Tweet Against BJP Leader Amit Malviya

Delhi High Court Orders Removal of Defamatory Tweet Against BJP’s Amit Malviya

The Delhi High Court has instructed the Samajwadi Party to delete a tweet that accused BJP IT Cell head Amit Malviya of rape. The order, issued on Friday by Justice Vikas Mahajan, came after Malviya filed a defamation lawsuit against the party.

Represented by Senior Advocates Arvind Nayar and Nalin Kohli, Malviya argued that the tweet, which included serious allegations, was damaging to his reputation. Nayar emphasized that the allegations, widely seen by the public, were harmful and baseless.

Justice Mahajan agreed with the request for an interim order and decided that the court notice would be served by hand (dasti).

Malviya’s defamation suit is linked to accusations against an SP leader in Uttar Pradesh’s Ayodhya. On August 3, SP Chief Akhilesh Yadav had called for a DNA test in relation to the allegations, but also suggested that if the claims were false, action should be taken against the officials involved. Malviya, in response, criticized Yadav’s tweet and the practices of the Samajwadi Party.

In retaliation, the SP Media Cell’s Twitter handle posted images of BJP leaders with individuals accused of rape, and further implicated Malviya in unsubstantiated claims of sexual misconduct. This led to Malviya’s legal action and the court’s directive to remove the tweet.
