Madhya Pradesh High Court Restores Membership of Lawyer, Requires Ice Cream Party as Part of Reinstatement

The Madhya Pradesh High Court has reinstated the membership of Ram Sahai Chiroliya in the Datia District Bar Association, overturning his previous suspension. The Court ruled that the suspension was not in accordance with the prescribed bylaws [Ram Sahai Chiroliya vs District Bar Association, Datia].

Chiroliya, previously accused of embezzling funds during his term as president, had pledged to host a High Tea and Ice Cream party as a gesture to demonstrate his commitment and goodwill towards the Bar members. The Court, in its decision, endorsed this gesture and instructed Chiroliya to honor his promise.

Justice Anand Pathak and Justice Rajendra Kumar Vani, presiding over the case, emphasized the need for Chiroliya to fulfill his undertaking as part of his reinstatement. They remarked, “Given his prior role as Head of the Bar Association from 2017-2019, it is appropriate for him to show magnanimity and fulfill his commitment to host the get-together for all Bar members.”

The District Bar Association had suspended Chiroliya’s membership in 2020, accusing him of failing to deposit a small amount of ₹4565 after his term ended. Chiroliya denied the embezzlement allegations and agreed to deposit the amount specified in the show-cause notice.

The Court’s judgment highlighted procedural lapses in the suspension process, noting that the membership removal lacked proper ratification from the General Body and consultation with the State Bar Council, as required by the model bylaws.

The Court’s ruling allows the District Bar Association to take further action in line with legal procedures if necessary. Advocates Gaurav Mishra, DP Singh, and Jitendra Sharma represented Chiroliya, the District Bar Association, and the State Bar Council of Madhya Pradesh, respectively.
