The Delhi High Court has rejected a bail application from a man accused of murdering the husband of a woman he was romantically involved with by pushing him in front of a moving train
The court cited the brutal nature of the crime as a key reason for denying bail.
Justice Subramonium Prasad emphasized that the seriousness of the crime is a significant factor in deciding whether to grant bail. He stated, “This court is of the opinion that there are reasonable grounds to believe that the petitioner has committed the offence. The petitioner is accused of committing murder in a brutal fashion. If convicted, the petitioner is likely to be sentenced to imprisonment for life or even death.”
Despite the accused being in custody since 2019 and considerable progress in the trial, including the examination of most witnesses, the judge was not inclined to grant bail due to the severity and nature of the offense.
According to the prosecution, the accused lured the victim to a deserted road near the railway tracks in Zakhira in 2019. There, he allegedly struck the victim’s head multiple times with a brick before pushing him in front of an oncoming train, which resulted in the victim’s body being severed. The accused then informed the victim’s family and attempted to portray the incident as an accident.
Police investigations revealed that the accused had a friendship with the victim’s wife and was fond of her. The accused’s legal defense argued that, given most witnesses had already been examined, there was no need for continued detention. They claimed the case against him was circumstantial and that he was wrongfully implicated.
The court, however, noted that the accused faced serious allegations, with evidence and witness testimonies suggesting his involvement. “The petitioner is accused of killing the husband of the lady he was in love with. The material on record discloses that the petitioner won the confidence of the deceased even though he was in love with his wife. The crime has been committed in a very brutal manner and the petitioner has tried to mislead the police at first and has also tried to give it the color of an accident,” the court observed.
