Delhi High Court Seeks Police Response on Mahua Moitra’s Plea to Quash FIR Over NCW Chief Tweet

The Delhi High Court on Friday issued a notice to the Delhi Police regarding a petition filed by Member of Parliament (MP) Mahua Moitra seeking to quash the First Information Report (FIR) registered against her for remarks made about National Commission of Women (NCW) Chief Rekha Sharma.

Justice Neena Bansal Krishna requested a response from the Delhi Police and scheduled the case for arguments on November 6.

Senior Advocate Indira Jaising, representing Moitra, argued that despite a written request, Moitra had not been provided with a copy of the FIR. Following this, the Delhi Police’s counsel handed over a copy of the FIR to Moitra’s legal team.

However, the Delhi Police also questioned the maintainability of Moitra’s plea, noting that she had challenged communications issued by the NCW to Lok Sabha Speaker Om Birla and the Delhi Police within the same petition.

Moitra, a Trinamool Congress (TMC) leader, was recently charged by Delhi Police under Section 79 (Word, gesture, or act intended to insult modesty of a woman) of the Bharatiya Nyaya Sanhita (BNS) for a tweet against Sharma. The tweet referenced a video showing NCW Chief’s staff holding an umbrella over her head during a visit to the site of a recent stampede in Hathras, Uttar Pradesh.

The FIR was filed after the NCW took suo motu cognizance of Moitra’s tweet, describing her comments as “extremely outrageous” and a “sheer violation of the women’s right to live with dignity.”

Moitra’s petition was filed through Advocate Paras Nath Singh.
