Uttarakhand High Court Grants Police Protection to Inter-Faith Couple, Orders UCC Registration within 48 Hours

The Uttarakhand High Court has recently granted police protection to an inter-faith couple in a live-in relationship, provided they register their relationship under the Uniform Civil Code (UCC) of Uttarakhand within 48 hours

The couple sought legal protection, alleging threats from the girl’s family. The court, led by Justices Manoj Kumar Tiwari and Pankaj Purohit, based its decision on the Supreme Court’s ruling in Lata Singh v. State of UP, which supports the protection of inter-faith couples.

The court directed that if the couple registers their relationship under the UCC within 48 hours, the local police station, SHO, PS Dalanwala, Dehradun, must ensure their protection for six weeks. After this period, the police should reassess the threat level and take necessary measures.

Section 378 of the Uniform Civil Code, Uttarakhand, 2024 requires partners in a live-in relationship to submit a registration statement to the local registrar, regardless of their place of residence.

The State’s counsel highlighted that the couple had not yet registered their relationship as required. The petitioners’ lawyer committed to complying with the UCC provisions.

This decision emphasizes the importance of registration for legal protection and safety for couples in similar situations.
