Supreme Court: Accused Cannot Be Required to Share Google PIN Location for Bail

Supreme Court Protects Privacy in Bail Conditions: No Sharing of Google PIN Location

The Supreme Court of India ruled on Monday that it is impermissible for courts to mandate an accused person to share their Google PIN location with authorities as a condition for granting bail. This decision was made in the case of [Frank Vitus v. Narcotics Control Bureau and Ors], highlighting the importance of protecting the accused’s privacy rights during the bail process.

A Bench comprising Justices Abhay S Oka and Ujjal Bhuyan delivered the verdict, emphasizing that bail conditions should not undermine the fundamental purpose of bail, which is to ensure the accused’s presence at trial without unduly infringing on their personal freedoms. The Bench stated, “Two things we have said. There cannot be bail conditions defeating the purpose of bail. We have said Google PIN cannot be a condition; police cannot peep into the accused’s private life for bail. And even regarding the NOC (No Objection Certificate), we have said it cannot be so stringent.”

This ruling reaffirms the judiciary’s stance on safeguarding individual privacy and ensuring that bail conditions remain fair and reasonable, without intruding excessively into an accused person’s private life.
