Senior Advocate Abhishek Manu Singhvi Highlights Lack of Grounds for Arrest, Challenges Violation of PMLA in Kejriwal Case
During the hearing of Delhi Chief Minister Arvind Kejriwal’s plea challenging his arrest by the Enforcement Directorate (ED) in the Delhi liquor policy case, Senior Advocate Abhishek Manu Singhvi alleged that the arrest was made following the implementation of the Model Code of Conduct, despite lacking any new evidence or grounds for action.
Singhvi informed the bench that Kejriwal had not filed a bail application before the trial court; instead, a writ petition challenging the arrest was submitted, citing the violation of Section 19 of the Prevention of Money Laundering Act.
The senior counsel argued that the arrest was unjustified as none of the documents filed from August 2022 until the arrest implicated Kejriwal in the alleged scam. Singhvi pointed out that neither the CBI FIR nor the ED Enforcement Case Information Report (ECIR) mentioned Kejriwal.
He emphasized that Kejriwal’s arrest was based on statements made under questionable circumstances, with some witnesses not even naming him in multiple statements. Singhvi highlighted the timing of the arrest, which followed the announcement of Lok Sabha elections.
Singhvi raised concerns about the timing of incriminating statements and questioned why Kejriwal was arrested in March 2024 when the statements were made between December 2022 and July 2023.
Furthermore, Singhvi noted similarities between Kejriwal’s case and that of former Delhi Deputy CM Manish Sisodia, suggesting a lack of new evidence to justify the arrest.
After Singhvi’s hour-long submission, the Supreme Court bench of Justice Sanjiv Khanna and Justice Dipankar Datta scheduled further proceedings for today.
