Delhi High Court Rejects Arvind Kejriwal’s Plea Against Arrest in Delhi Excise Policy Case
In a setback for Chief Minister Arvind Kejriwal, the Delhi High Court on Tuesday dismissed his plea challenging his arrest in the Delhi excise policy case. The court asserted that the material gathered by the Enforcement Directorate (ED) indicates his involvement in conspiratorial activities both in his personal capacity and as the convenor of the Aam Aadmi Party (AAP).
The court emphasized that the ED possessed sufficient evidence to justify Kejriwal’s arrest in connection with a money laundering case. It also dismissed his objections regarding the use of an approver’s statement, stating that the process of granting pardon to an approver falls under the judicial domain, not that of the ED.
Furthermore, the court ruled against Kejriwal’s proposal for questioning through video conferencing, asserting that the method of investigation is not subject to the accused’s discretion. The court reiterated the principle of equality before the law, emphasizing that public servants cannot expect preferential treatment.
Kejriwal’s argument regarding the timing of his arrest, particularly in the context of general elections, was also rebuffed by the court. It clarified that unless there is evidence of malice on the part of the ED, challenging the timing of the arrest before elections lacks merit.
In essence, the Delhi High Court’s ruling underscores the necessity of upholding legal procedures and principles of equality in the face of legal challenges, regardless of the political context.
